TERMS OF SERVICE
OVERVIEW
This website is operated by StormLine Supply. Throughout the site, the terms “we”, “us” and “our” refer to StormLine Supply. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein.
SECTION 1 - PAYMENT & ORDER ACCEPTANCE
ALL ORDERS REQUIRE 100% UPFRONT PAYMENT. StormLine Supply does not offer Net-30, credit terms, or COD. No equipment will be released, processed, or shipped until funds have fully cleared our accounts.
• Verification: We reserve the right to request additional identification or professional verification for high-value orders to prevent fraudulent transactions.
• Order Cancellation: We reserve the right to refuse or cancel any order for any reason, including but not limited to: pricing errors, inaccuracies in product descriptions, or suspected fraudulent activity. If your order is canceled after payment, a full refund will be issued to the original payment method.
SECTION 2 - "AS IS" SALE & WARRANTY DISCLAIMER
STORMLINE SUPPLY IS A DISTRIBUTOR, NOT A MANUFACTURER.
TO THE FULLEST EXTENT PERMITTED BY LAW, ALL PRODUCTS ARE SOLD ON AN "AS IS" AND "WITH ALL FAULTS" BASIS. SELLER MAKES NO WARRANTIES, EXPRESS OR IMPLIED, AND SPECIFICALLY DISCLAIMS THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
• Any warranty protection is provided solely by the original manufacturer of the equipment.
• Buyer agrees to look exclusively to the manufacturer for any claims related to defects, performance, or repairs. StormLine Supply does not provide labor, travel reimbursement, or "loaner" equipment for warranty-related issues.
SECTION 3 - LIMITATION OF LIABILITY
IN NO EVENT SHALL STORMLINE SUPPLY, OUR DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND.
This includes, without limitation:
• Lost profits, lost revenue, or loss of business opportunity.
• Network downtime, service outages, or data loss.
• Labor costs associated with re-splicing, re-testing, or construction project delays.
• Personal injury or property damage resulting from the use or failure of tools.
OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER SHALL BE LIMITED TO THE AMOUNT PAID BY YOU FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
SECTION 4 - INDEMNIFICATION
AS A CONDITION OF SALE, BUYER AGREES TO INDEMNIFY, DEFEND, AND HOLD HARMLESS STORMLINE SUPPLY AND OUR SUBSIDIARIES, PARTNERS, AND EMPLOYEES FROM ANY AND ALL CLAIMS, DEMANDS, SUITS, OR DAMAGES (INCLUDING REASONABLE ATTORNEYS' FEES) MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF YOUR USE, MISUSE, OR RESALE OF THE PRODUCTS PURCHASED.
This includes claims alleging strict liability, negligence, or defects in the design or manufacture of the goods. If Buyer initiates legal action against Seller and does not prevail, Buyer shall reimburse Seller for all legal fees and costs incurred.
SECTION 5 - PROFESSIONAL USE & SAFETY
Buyer acknowledges that line construction and fiber optic equipment (including fusion splicers, cleavers, and climbing gear) are industrial tools intended for use by certified professionals. Buyer assumes all risk associated with the operation of these tools. StormLine Supply is not responsible for damages resulting from improper training, lack of field calibration, or failure to follow manufacturer safety guidelines.
SECTION 6 - SHIPPING, TITLE, & RISK OF LOSS
• FOB Shipping Point: Title to the goods and the "Risk of Loss" pass to the Buyer the moment the package is delivered to the carrier (UPS, FedEx, DHL, etc.).
• International Orders: All duties, taxes, VAT, and brokerage fees are the sole responsibility of the Buyer. If a package is returned due to unpaid customs fees, the original shipping cost and a 25% restocking fee will be deducted from any refund.
• Returns: Non-defective returns are subject to a 25% restocking fee. Electronic and optical equipment (e.g., fusion splicers, OTDRs) cannot be returned once the factory seal is broken.
SECTION 7 - GOVERNING LAW & VENUE
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Pennsylvania. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Clearfield County, Pennsylvania.

SECTION 9 - INTERNATIONAL TAXES, DUTIES, AND VAT
StormLine Supply ships worldwide from the United States. For all orders shipped to destinations outside of the United States, the following terms apply:
• Importer of Record: The Buyer is considered the "Importer of Record" and must comply with all laws and regulations of the destination country.
• VAT and Duties: Prices displayed on our website are in USD and do not include Value Added Tax (VAT), Goods and Services Tax (GST), or any other foreign import duties. These fees are not calculated or collected by StormLine Supply at checkout.
• Payment Responsibility: All applicable customs fees, import duties, taxes (VAT/GST), and brokerage fees are the sole responsibility of the Buyer upon delivery. These fees are determined by the local customs authority and must be paid by the Buyer to the carrier or government before the equipment will be released.
• Customs Delays and Refusal: StormLine Supply is not responsible for delays caused by customs processing. If a shipment is refused by the Buyer due to unexpected VAT or import fees, the package will be returned to us. In such cases, the original shipping cost is non-refundable, and a 25% restocking fee will be deducted from any potential refund.
• Documentation: For B2B transactions, Buyers should provide their VAT Registration Number in the order notes to facilitate faster customs clearance. We will not "undervalue" or mark items as "gifts" on customs declarations, as this violates federal and international law.
SECTION 10 - TRADE COMPLIANCE & DOCUMENTATION The Buyer is responsible for providing any and all necessary trade registration numbers required by their local jurisdiction (including, but not limited to, EORI, VAT, or Tax ID numbers) at the time of purchase. StormLine Supply is not responsible for shipment delays, seizures, or returns resulting from the Buyer’s failure to provide accurate trade documentation. Furthermore, the Buyer agrees to comply with all U.S. Export Administration Regulations (EAR) and acknowledges that they are not a restricted party on any U.S. government "denied persons" list.
